How does small claims service work in San Diego?
Rockstar serves small claims papers in San Diego County at the same prices as other civil papers: $195 for same day, $175 for next day, and $150 for standard. Each of those includes four attempts at the address you provide. You upload the papers you want served. The office does not write the claim, does not tell you what to put on it, and does not say how a hearing will come out.
For a San Diego County case, the proof of service/declaration is mailed for self-represented people at no extra charge, and a copy is emailed to you. If you are not representing yourself, or the court is outside the county, ask before you rely on that mailing. Call 619-399-3278 Monday through Friday, 7am–5pm PST, and say it is a small claims serve so the job is set up on the right court.
Service attempts are also made outside of these office hours.
What Rockstar does with the papers
You choose the turnaround on the order, attach the small claims documents to that job, and enter the person and the address. Same day means the first attempt the same day the order starts. Next day means the first attempt the next day. Standard means the first attempt within one to three days. Next day process serving is the middle price, at $175, when you want the first try on the following day rather than the same afternoon.
An order placed after 5pm PST is processed the next business day. Printing is included for the first 40 pages and is $.30 per page after that. An extra person at the same address is $40 on same day, next day, and standard only. A second address is a separate serve at the full price. If the attempts run out without service, you receive a declaration of due diligence rather than a proof of a completed serve.
San Diego courts these papers often name
Small claims papers on this site are tied to San Diego Superior Court locations: Central in downtown San Diego, North County in Vista, East County in El Cajon, and South County in Chula Vista. Put the courthouse that is on your papers into the order so the caption matches. Rockstar does not pick a courthouse for you and does not move a case from one division to another.
The US District Court for the Southern District of California is a federal court, not a small claims department. If your papers are for that court, say so on the order. The county mailing for self-represented people is for San Diego County proofs. A federal proof is emailed or mailed back to you to file, unless you order filing as a separate job. The proof of service guide walks through that split.
Filing the claim is a separate job
Serving the defendant and filing papers with the court are different orders. Court filing or retrieval at San Diego County courts is $250 the same day, $200 the next business day, or $150 within one to three business days. Drop or department box filing is $150, $115, or $70 on those same turnarounds. Filing, certification, and copy fees that Rockstar advances add 8% or $4.00, whichever is greater.
Use drop box filing when you want a proof hand-delivered instead of mailed. The no-extra-charge mailing still covers a San Diego County proof for a self-represented person after an in-person serve. If a business is the defendant, name the person who should receive the papers and the business they receive them for. The serving a business guide covers that job detail.
What to have ready before you pay
Open the order form, add the serve, and upload the small claims set with that job. Include the case number if you already have one, the court location, the person to be served, and a usable address. If you do not have a case number yet because the claim still has to be filed, leave the number blank. A missing case number does not hold up the proof.
The FAQ covers attempts, rural surcharges, and proofs in shorter form. The contact form is there when the papers do not match one of those answers. Rural outlying towns such as Fallbrook, Alpine, and Ramona are $45 more and include three attempts. Extra-rural addresses are $100 and two attempts, and those should be confirmed by phone before you order. Call 619-399-3278 rather than guessing the surcharge.
Can Rockstar serve small claims papers?
Yes. Small claims papers use the same prices as other in-person serves: $195 same day, $175 next day, and $150 standard, each with four attempts. You upload the papers on the order. Rockstar does not prepare the claim and does not advise you on what the court will do with it.
Which San Diego courts can the proof be mailed to?
For self-represented people, San Diego County proofs of service/declarations are mailed at no extra charge, with an email copy to you. The Superior Court locations this office works with are Central in downtown San Diego, North County in Vista, East County in El Cajon, and South County in Chula Vista. Proofs for other courts are sent back to you to file.
Is filing the small claims case included in the serve?
No. The serve price covers attempts and the proof. Filing or retrieval is a separate order: $250 same day, $200 next day, or $150 within one to three business days.
